ABI's Newest Title Provides Practitioners with Insights on Out-of-Court Restructuring Strategies
Alexandria, Va. — The American Bankruptcy Institute has just released The Professional's Guide to Nonbankruptcy Alternatives to give practitioners practical out-of-court restructuring strategies and how they may fit with the needs of a distressed business. As bankruptcy is only one instrument in the insolvency professional’s toolbelt, authors Michael DiPietro, Ashley Champion and Michael Riedl of Polsinelli touch on creditor compositions, Restructuring Support Agreements (RSAs), assignments for the benefit of creditors, UCC Article 9 foreclosures and receiverships for ailing companies not able to afford the time and costs of a bankruptcy proceeding.
“A successful restructuring comes in all shapes and sizes, and we all need to be ready to react when those instances arise,” according to the authors in the introduction to The Professional's Guide to Nonbankruptcy Alternatives. “This book is a guide for restructuring professionals to garner the knowledge necessary to consider out-of-court workouts as a means to a restructuring end.”
